Welcome to HotSwapUSA.com. These Terms and Conditions ("Terms") govern your use of our website (the "Site") and services provided by Hot Swap USA ("Company," "we," "us," or "our"). By accessing this Site or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our Site.

1. Services

Hot Swap USA provides tankless water heater consultations, installations, and rebate processing services to homeowners in California. Our services are subject to availability and eligibility based on site conditions and rebate program guidelines.

2. Eligibility for Rebates

Customer must have an active SoCal Gas account at the property where the new tankless unit will be installed in order to qualify for the discount.

3. Pricing

Installation pricing is determined based on an in-home or virtual consultation. The cost of the tankless unit may be offset entirely or partially by applicable rebates. Final pricing will be confirmed in writing before any work begins.

4. Scheduling and Cancellations

We offer free virtual consultations. Once scheduled, customers must notify us of cancellations or rescheduling at least 24 hours in advance. Missed appointments may result in delays or rescheduling fees.

5. Warranties and Guarantees

We provide a workmanship warranty of 1 year on all installations. Manufacturer warranties on water heaters are separate and subject to the terms set by the manufacturer.

6. Limitation of Liability

Hot Swap is not liable for any indirect, incidental, or consequential damages resulting from the use or installation of our products or services. Our total liability under any circumstances shall not exceed the total amount paid for the installation service.

7. Intellectual Property

All content on this Site, including text, graphics, logos, and images, is the property of Hot Swap and may not be copied, distributed, or used without prior written consent.

8. Privacy Policy

Our Privacy Policy explains how we collect, use, and protect your personal information. By using our Site, you agree to the collection and use of information as described in our Privacy Policy.

9. SMS / Text Message Communications

Hot Swap USA is a licensed water heater installation and rebate processing company. When you affirmatively opt in by checking a consent box on our website forms, Hot Swap USA may send you text messages related to your inquiry or service. Two message types are offered as separate opt-ins:

• Transactional messages: appointment confirmations, audit scheduling, and service updates.
• Marketing messages: special offers, rebate and incentive program updates, and service promotions.

Message frequency varies. Message and data rates may apply, depending on your wireless carrier plan.

Carriers are not liable for delayed or undelivered messages. Message delivery may be delayed or fail due to carrier or network issues outside of our control.

10. Governing Law

These Terms are governed by the laws of the State of California. Any disputes shall be resolved in the appropriate courts of Orange County, CA.

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with the updated effective date.
